The Statute Behind the Boundary Question

Act 169 of 1970, at MCL 399.201 and following, allows a local unit to establish districts. Section 399.205(1) then requires a permit before any exterior work within one, with work defined to include repair.

Section 399.205 also contemplates restoration or modification of work done without a permit, and appeals run to the Review Board and then to circuit court.

Act 169 dates from 1970, and studies of designated Michigan districts have found values do not decrease, with Heritage Hill rising 1200 per cent between 1974 and 2002.
